Heritage Home Improvements Limited Workmanship Warranty
Heritage Home Improvements llc ("Contractor") hereby guarantees ______________________ ("Owner") that the construction performed on that certain structure located at _________________________________ to be free from defects in workmanship for a period of 1 year of normal use, from the completion or date of notice of completion, whichever is the first to occur:
This Standard Limited Warranty applies and is limited as follows:
1. To the property only as long as it remains in the possession of the original owner named above. Proof to be supplied.
2. To the construction work that has not been subject to accident, misuse, abuse, or lack of proper maintenance.
3. To the construction work that has not been modified, altered, defaced, or had repairs made or attempted by others.
4. That Heritage be immediately notified in writing within ten (10) days of first knowledge of defect by owner or his agent describing the location and details of the defect. Upon discovery of a possible defect the owner at his expense must immediately provide for protection of all property that could be affected until the defect is remedied.
5. That Heritage shall be given first opportunity to make any repairs, replacements or corrections to the defective construction at no cost to owner within a reasonable period of time.
6. Under no circumstances shall Heritage be liable by virtue of this warranty or otherwise for damage to any person or property whatsoever for any special, indirect, secondary or consequential damages of any nature however arising out of the use or inability to use because of the construction defect.
7. This workmanship warranty does not include any damages or defects in the product unless caused by Heritage's installation of the product.
8. This warranty does not include acts of God including, but not limited to, hurricanes,tornados,floods,earthquakes,severe weather, or unusual climate conditions or any cause other than workmanship defects.
9. We have the right to inspect the areas at issue to determine the cause of the alleged defects. If the defects are determined to be within the scope of the workmanship warranty Heritage will make the necessary repairs at our expense.We do not warrant the installed products.
10. Settlement or Structural movement of material to which installed products are attached.
11. Any repairs made by Heritage shall constitute a full settlement and release of all claims for damage or other relief and a complete bar to any litigation filed subsequently.
